Abstract

The objective of this work is to identify the rights of children who would be being violated due to the lack of regulation of the SAP. The analysis focuses on the second research problem of the thesis: "Parental Alienation Syndrome and its violation of the rights of children or adolescents". This study uses a doctrinal methodology, but also a jurisprudential one, since, through the sentences found in relation to the SAP, it is evident that there is no unifying criterion in the judicial decisions, and through which the rights can be denoted and recognized. of the children who would be violated, which result in the following: the right of the child to have a family, the right to personal integrity, the right to free development of their personality, the right to identity and the right to freedom of opinion; likewise the principle of special protection for the child and the principle of the best interest of the child.
