Surrogate motherhood, alteration of filiation and impact on the right to identity of the minor in Peru

Abstract

The objective of this research was to analyze to what extent surrogate motherhood or surrogate motherhood affects the right to identity of the minor, and results in the alteration of the minor's filiation established in article 145 of the Penal Code in Peru. The research was of the Basic type, non-experimental, cross-sectional design, descriptive and inferential level, social legal research method with a mixed approach of statistical and non-statistical methods, which allows reasoning based on particular cases, to general knowledge. To collect the information, the questionnaire was applied, and the documentary research as measurement instruments; which allowed to collect information, and measure the study variables. The sample consisted of 219 law professionals. The results obtained allowed us to establish that: Surrogate motherhood significantly affects the right of identity of the minor in Peru, due to the legislative vacuum in criminal matters in that sense.
